1. Introduction
1.1. We are an association providing services in the field of organizing conferences and other events (including online) focused primarily on web designers and developers oriented towards HTML, CSS and JavaScript (" Events "), which can be attended by registering on the website https://www.frontkon.tech via the SimpleShop platform (" Portal ").
1.2. These terms and conditions govern the rights and obligations arising from the contract for the provision of the Event concluded through the Portal (" Contract "). The provisions of these terms and conditions are an integral part of the Contract. Deviating provisions in the Contract take precedence over the provisions of these terms and conditions. These terms and conditions and the Contract are concluded in the Czech language.
1.3. The aim of these terms and conditions is to inform you of our mutual rights and obligations. Our relationship is governed by Czech law, in particular the effective Civil Code (" Civil Code ").
1.4. By visiting and browsing the Portal, and/or completing the registration form, you confirm that
1.4.1. you have read these terms and conditions, and
1.4.2. that you understand and agree with them.
2. How does it all start?
2.1. If you are interested in participating in the Event, please complete the registration form on the Portal for the relevant Event you are interested in (" Order "). Submit your order by clicking the [Complete Purchase] button.
2.2. We will consider the information provided in the Order to be correct. The condition for the validity of the Order is:
2.2.1. filling in all mandatory information in the registration form,
2.2.2. Your confirmation that you agree to these terms and conditions and that you have read the information on the processing of personal data and
2.2.3. payment of the price for participation in the Event specified within the given Event on the Portal.
2.3. All information about the Events displayed on the Platform is for informational purposes only and we are not obliged to conclude a Contract regarding the provision of these Events. After submitting a valid Order, we will consider this Order and, if we agree with it, we will send you a confirmation of its acceptance by e-mail. Our confirmation of acceptance of the Order is considered to be the conclusion of the Contract. Please note that the Order, if confirmed by us, obliges you to pay the price for participation in the Event.
2.4. In the event that we cannot meet any of the requirements set out in the Order, we will send you an amended offer to your email address (“ Amended Offer ”). The amended offer is considered a new draft of the Agreement and the Agreement is concluded in such case upon delivery of your confirmation of acceptance of this Amended Offer to our email address set out in these Terms and Conditions.
2.5. Orders that we have accepted are binding. Amended offers that you have confirmed are also binding.
3. Important information for participating in the Event!
3.1. As we have already mentioned above, participation in the Event is conditional on payment of the price. The exception is Events with free admission, for which it is sufficient to meet the conditions according to Articles 2.2.1 and 2.2.2. above and receive our Order confirmation.
3.2. By registering and participating in the Event, you acknowledge that photographs and audiovisual recordings of participants may be taken in connection with the Event, and you agree to such taking and recording. You are not entitled to any remuneration or other compensation for the taking and use of such photographs and audiovisual recordings. If you do not wish to be audio/visually recorded at the Event, please inform the organizers, or the photographer or cameraman, in any way possible, at the latest upon entering the Event. In such a case, you will not be recorded.
3.3. We reserve the right to change the program. In the event of a change to the program, we will inform you in advance. If you do not agree with the change to the program, you have the right to cancel your participation in the Event free of charge before it takes place according to Art. 5.1. and we will refund the price.
3.4. We are not liable for any damage, including lost profits, caused in connection with the performance of this Agreement (for example, the Event does not take place, takes place later or a promised speaker does not appear). Our liability to compensate for any damage caused is limited to 50% of the price paid by you for participation in the Event.
3.5. We are also entitled to withdraw from the Contract due to unavailability of seats at the Event or without giving a reason. In the event of withdrawal from the Contract, we will inform you via the e-mail address specified in the Order and we will refund all funds to you.
3.6. Finally, we are entitled to withdraw from the Contract if the organization of the Event becomes unlawful.
4. What and where should I pay?
4.1. The price for participation in the Event is agreed between us by confirming the Order or confirming the Amended Offer.
4.2. The price for participation in the Event includes admission for 1 person and participation in the program. The Event program is described on the Portal for each individual Event, or will be communicated to you in an email sent after sending a valid Order to the email address specified in the registration form.
4.3. You can pay the price for participation in the Event via the Portal cashless online by bank transfer or online by credit card. In the case of payment by card via an online payment gateway, you are obliged to follow the instructions and conditions of the payment gateway operator.
4.4. Your obligation to pay the price for participation in the Event is fulfilled when the relevant price is credited to our account.
4.5. For each payment, a tax document - invoice will be issued and sent to the email address provided in the registration form or via which we communicate together after payment. This will meet the requirements of legal regulations.
4.6. All prices are listed excluding VAT, unless otherwise stated on the Portal.
4.7. In the event that there is an obvious technical error on our part when stating the price for participation in the Event on the Portal or during the ordering process, we are not obliged to provide you with the Event at this obviously incorrect price, even if we send you a confirmation of receipt of the Order. We will inform you of the error without undue delay and send you an amended offer to your e-mail address. The amended offer is considered a new draft of the Contract and in such a case the Contract is concluded by a confirmation of acceptance of the amended offer sent to our e-mail address.
5. Can I cancel my participation in the Event?
5.1. The agreed participation in the Event can be cancelled before the date of the Event based on our mutual agreement. Send your e-mail to the e-mail address specified in these Terms and Conditions, indicating the bank account number for the refund of the price for participation in the Event, if you are entitled to it under these Terms and Conditions. The date of cancellation of participation is considered the day of delivery of the confirmation e-mail about the cancellation of participation in the Event from our side.
5.2. If you are not a consumer within the meaning of the Civil Code, then the following cancellation fees apply to you for canceling your participation in the Event:
5.2.1. cancellation of participation in the Event within 14 calendar days before the Event = refund of 100% of the price for participation in the Event;
5.2.2. cancellation of participation in the Event later than 14 calendar days before the Event = the price for participation in the Event is not refundable.
5.3. Based on an individual agreement, we may waive the cancellation fee. If you are entitled to this, the price for participating in the Event will be refunded to you by bank transfer within 30 business days of receiving the relevant bank account number to which you wish to refund the price.
5.4. If you do not participate in the Event for reasons other than our fault (for example, you forget about the Event or your internet connection drops), this does not constitute a breach of our obligations under the Agreement and is not considered a withdrawal from the Agreement. On the contrary, in such a case you are obliged to pay the full price for participation in the Event.
6. Are you a consumer? Then beware!
6.1. If you are a consumer within the meaning of the Civil Code, i.e. a person who acts towards us outside the scope of their business activities, the provisions of this Article 6 apply to you, among other things.
6.2. Before submitting your Order, you are allowed to check and change the information contained in the registration form for the purpose of verification. We consider the information in the registration form to be current, true and accurate.
6.3. You will pay the costs of using communication means incurred in connection with the closing negotiations yourself, provided that these costs do not differ in any way from the basic rate.
6.4. If the Event provided by us does not have the agreed features (for example, the promised speaker does not participate), you can notify us of such a defect and exercise your rights from defective performance by sending an e-mail to the e-mail address specified in these terms and conditions. For a complaint, you can use the sample complaint form provided by us in Appendix No. 1 to these terms and conditions.
6.5. We will handle the complaint by arranging a replacement Event or providing you with an appropriate discount. If the claimed defect constitutes a material breach of the Contract, you may also withdraw from the Contract.
6.6. Within three days of receiving the complaint, we will confirm to your email address that we have received the complaint, when the complaint was filed, and the expected duration of the complaint resolution.
6.7. We will handle the complaint without undue delay, but no later than 30 days from receipt of the complaint. The deadline may be extended by mutual agreement. If the deadline expires in vain, you may withdraw from the Contract.
6.8. We will notify you by email when your complaint has been resolved. If the complaint is justified, you are entitled to compensation for the costs incurred. You are required to prove these costs, e.g. with receipts.
6.9. The exercise of rights arising from defective performance and claims for action is governed by the provisions of §1810 et seq., §1820 et seq. and §2099 et seq. of the Civil Code and the Consumer Protection Act.
6.10. If the Contract is concluded online, remotely or outside our premises, you have the right to withdraw from the Contract within 14 days of its conclusion without giving any reason. You can withdraw in writing or by sending an e-mail to the e-mail address specified in these Terms and Conditions. In order to comply with the 14-day period, this withdrawal must be sent before its expiry. To withdraw from the Contract, you can use the sample form for withdrawal from the Contract provided by us in Annex No. 2 to these Terms and Conditions.
6.11. You cannot withdraw within the statutory 14-day period if we have already provided the performance within the withdrawal period at your request. In the case of Events, such a request is to register for an Event with a date within 14 days of registration.
6.12. If you withdraw from the Contract within the statutory period of 14 days, although performance has already begun based on your own request, you are obliged to pay us a proportional part of the performance.
6.13. We are entitled to withdraw from the Contract due to the unavailability of seats at the Event. In such a case, we will inform you immediately via the e-mail address specified in the Order and will return all funds within 14 days of the notification of withdrawal from the Contract, in the same manner or in the manner specified by you.
6.14. We are also entitled to withdraw from the Contract if a technical error in the online store results in a completely obvious error in the price of the goods, or if the performance becomes unlawful.
6.15. According to the Consumer Protection Act, you have the right to out-of-court settlement of a consumer dispute arising from the Contract. In such a case, you are entitled to contact the Czech Trade Inspection (Central Inspectorate – ADR Department, Štěpánská 15, 120 00 Prague 2, e-mail: [email protected], website: adr.coi.cz). Out-of-court settlement of a consumer dispute is initiated exclusively upon your request, if the dispute has not been resolved directly with us. The request can be submitted no later than 1 year from the date on which you first exercised your right, which is the subject of the dispute, with us.
6.16. You have the right to initiate an out-of-court dispute resolution online through the ODR platform available at the website ec.europa.eu/consumers/odr/.
6.17. The contract, including the terms and conditions, is archived in electronic form and is not accessible.
7. Processing of personal data
7.1. The processing of personal data is governed by a separate document entitled Information on the Processing of Personal Data. By submitting an Order, you confirm that you have read this document.
8. In conclusion
8.1. We will deliver all written correspondence to each other by electronic mail. Our e-mail address is stated in the header of these Terms and Conditions. We will deliver correspondence to your e-mail address stated in the Order or through which you contacted us.
8.2. The contract may only be amended by our written agreement. However, we are entitled to amend and supplement these terms and conditions, and we will inform you in advance of the changes by publishing the changes on the Portal with the effective date of the marked changes at least 14 days in advance. Upon the entry into force of the new terms and conditions, the original terms and conditions shall cease to be valid. If we do not receive from you within this time to the e-mail address specified in these terms and conditions termination, it is considered that you agree with the new wording of the terms and conditions.
8.3. In the event of force majeure or events that cannot be foreseen (natural disaster, pandemic, operational disruptions, subcontractor outages, etc.), we are not liable for damage caused as a result of or in connection with force majeure, and if the force majeure situation lasts for more than 10 days, we are entitled to withdraw from the Contract.
